Scott Eisman leverages his deep government experience to advise on complex commercial litigation, appeals, and high-stakes investigations for financial institutions and major corporations.

In private practice, Scott has delivered results in high-profile disputes and investigations for market-leading clients. At a prominent global law firm, he defended Google against antitrust claims related to advertising technology and in a commercial litigation involving a cryptocurrency scheme. He also represented the largest African telecommunications company in an Anti-Terrorism Act litigation, contributed to resolving criminal and regulatory investigations into Volkswagen’s diesel emissions controversy, and successfully dismissed securities lawsuits on behalf of clients 3M, Morgan Stanley, and Credit Suisse. Scott has authored many amicus curiae briefs in trial and appellate courts, including the U.S. Supreme Court. As an Assistant Solicitor General in the New York State Office of the Attorney General, Scott argued nearly 20 appeals and dispositive motions and authored dozens of briefs, including one for the U.S. Supreme Court that won the National Association of Attorneys General’s 2019 Supreme Court Best Brief Award.
A graduate of Columbia Law School, Scott was a Harlan Fiske Stone Scholar and managing editor of the Columbia Law Review. He began his career clerking for the Honorable Louis L. Stanton of the U.S. District Court for the Southern District of New York. Today, Scott leverages his extensive appellate experience to help run Twenty Eagle, a blog dedicated to the New York Court of Appeals.

- Defended MTN Group, the largest mobile operator in Africa, against Anti-Terrorism Act claims relating to MTN’s operations in Iran and Afghanistan.
- Represented a biotech company in a multiday arbitration about the terms of a collaboration agreement with another biotech company.
- Obtained reversal in the U.S. Court of Appeals for the Second Circuit in a false-advertising case against a supplement manufacturer under the Federal Trade Commission Act and New York’s General Business Law.
- Prevailed in the New York Appellate Division in a first-of-its-kind case about the New York Attorney General’s authority to regulate cryptocurrency.
- Represented a private equity firm in a post-closing dispute over the allocation of liabilities under a contract to purchase a chemical company.
- Defended a major financial institution in multiple class actions alleging collusion in precious-metals markets.
- Secured complete dismissals with prejudice of securities and derivative suits against 3M relating to the company’s accounting practices.
- Represented Volkswagen in the resolution of U.S. criminal and regulatory investigations arising from its diesel emissions issues, as well as related regulatory investigations and civil litigations in dozens of other countries.
- Prevailed before the U.S. Supreme Court in challenging the addition of a citizenship question on the decennial census.
- Obtained a reversal in the U.S. Court of Appeals for the Second Circuit of an order dismissing claims that a dietary supplement manufacturer misled consumers about the efficacy of its products.
- Obtained a district court dismissal and affirmance by the U.S. Court of Appeals for the Second Circuit in a case alleging violations of the Securities Act of 1933.
- Represented a financial institution in connection with various lawsuits relating to residential mortgage-backed securities and collateralized debt obligations.
