Axinn’s Thomas Rohback Named A “Winning” Litigator by The National Law Journal
Washington, D.C. - Axinn, one of the country’s leading antitrust, IP and litigation law firms, today announced The National Law Journal has named Thomas G. Rohback, Co-Chair of the firm’s Complex Litigation Group, to its annual list of “Winning” Litigators in the United States. Mr. Rohback and 13 other “Winning” Litigators were honored on June 8th at The Most Influential Lawyers & “Winning” Litigators Annual Dinner and will also be profiled in the June 20th issue of The National Law Journal.
“Winning” Litigators were selected from hundreds of attorneys from firms of all sizes across the country who could claim at least one significant bench or jury trial verdict within the past 18 months and who had a record of success over many years. The National Law Journal sought cases in which substantial damages were at stake or in which the attorneys prevailed in a hostile jurisdiction.
An experienced trial and appellate lawyer, Mr. Rohback was selected as a “Winning” Litigator for his exemplary record of successfully defending clients in very challenging class actions and complex commercial litigation cases. Most recently, he defended The Hartford Insurance Company in what became one of the few class action cases ever to proceed to a jury verdict. Mr. Rohback was asked to take over the case from a previous legal team and defend the insurance company in a class action lawsuit in a jury trial being heard in a state court in Connecticut.
The plaintiffs were seeking almost $110 million in damages plus trebled punitive damages of nearly $330 million, plus attorneys’ fees for a case that had been litigated for six years. The state court had already certified a plaintiff class, the state’s Supreme Court had affirmed the class certification and discovery was closed. Mr. Rohback skillfully and methodically picked apart the plaintiffs’ case, revealed the disparities of their claims and convinced a jury to award the plaintiffs a mere $14 million in damages, reflecting the tenuous liability finding.
During his 33-year career, Mr. Rohback’s cases have involved diverse subjects, including class actions and complex commercial litigation ranging from antitrust to anti-terrorism litigation. The industries in which Mr. Rohback has represented clients range from manufacturing to insurance and telecommunications. He has handled intellectual property and complex commercial cases throughout the United States. During one year, Mr. Rohback tried three federal court jury cases in a three-month period and obtained a directed verdict in each case. A New York-based lawyer, Mr. Rohback has also successfully represented another insurance company in a jury verdict in the state of West Virginia as well as spearheaded numerous trials in New York and Pennsylvania state and federal courts.
