Daniel Oakes, Tiffany Rider, and Lindsey Strang Aberg Win “Law360 Distinguished Legal Writing Award”

An article by partners Daniel Oakes and Tiffany Rider and counsel Lindsey Strang Aberg was selected for The Burton Foundation's "Law360 Distinguished Legal Writing Awards." This award recognizes outstanding legal writing, with only 20 articles selected annually by the nation's top law firms.
Daniel, Tiffany, and Lindsey were honored for their article, "Losing Per Se: Potential Fallout From the U.S. Department of Justice’s No-Poach Enforcement," which originally appeared in the Concurrences Review publication, “No-Poach Agreements – Closing the Enforcement Gap.”
Their article analyzes the DOJ Antitrust Division’s recent criminal prosecution efforts in labor market cases, particularly against “no-poach” agreements that restrict employee mobility through hiring or solicitation bans. The DOJ’s efforts to categorize these agreements under the per se rule—which removes the need to prove anticompetitive effects—have raised significant legal questions. By examining key cases such as DaVita and Patel, the authors explore whether the DOJ’s prosecution outcomes risk undermining its key prosecution tool—the per se rule itself.
Winners will be honored at an awards ceremony on May 19, 2025, at the Library of Congress in Washington, D.C.
